Terms of Service

1. Acceptance of Terms

By creating a Commerce OS account, accessing the dashboard, or using any of the POS / Management / storefront surfaces, you agree to these Terms of Service. If you’re accepting on behalf of a business, you represent that you have authority to bind that business to these terms.

These terms apply to every product surface — dashboard, POS web, RN POS, Management app, customer-facing storefront, and the underlying Commerce OS API.

2. Your account

You’re responsible for maintaining the confidentiality of your account credentials (email + password, PIN codes for cashier fast-switch, MFA tokens). You’re responsible for every action taken under your account, including by employees you’ve provisioned via the dashboard.

You must notify us promptly at [email protected] if you suspect any unauthorized access. We provide tools to deactivate users + rotate JWT secrets but you control your operational policies.

3. Subscription, fees, and billing

Commerce OS is offered on monthly or annual subscription plans. Plan tiers + included quantities (locations, terminals) are listed on our pricing page. Prices may change with 30 days’ notice; existing annual subscriptions are honored at the locked-in rate through the end of the prepaid period.

Annual prepayments are non-refundable for the prepaid period; you keep platform access through the end of your billing year on cancellation. Monthly plans cancel any time, no fees.

Payment processing fees are paid directly to Stripe at Stripe’s standard rates. Commerce OS does not mark up payment processing.

4. Your data

You own all data you submit to Commerce OS — products, customers, orders, payments, employee records. Commerce OS holds this data as a processor on your behalf (we are the controller solely for our own operational telemetry).

You can export your data at any time via the dashboard or our API. On account termination, we retain data for 30 days for recovery, then permanently delete operational records (financial records are retained per IRS / FLSA requirements with PII anonymized).

5. Acceptable use

You agree to use Commerce OS in compliance with all applicable laws. See our Acceptable Use Policy for the full list of prohibited uses (illegal goods, regulated industries without proper licensing, fraud, etc.).

We reserve the right to suspend or terminate accounts engaged in prohibited activity; we’ll do so with notice except in cases of imminent harm.

6. Service availability

Commerce OS targets 99.9% uptime exclusive of scheduled maintenance windows. We don’t offer formal SLAs at the launch tier; enterprise SLAs are available via custom agreement.

Where the API is degraded but our offline-first POS surfaces remain functional, we count those minutes as fully available — your business keeps running.

7. Limitation of liability

To the maximum extent permitted by law, Commerce OS’s total liability for any claim is limited to the fees you paid in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

We disclaim all warranties to the extent permitted by law. The platform is provided "as is" with the explicit posture documented on our security + status pages.

8. Changes to these terms

We may update these terms periodically. Material changes will be communicated via email at least 30 days before they take effect. Continued use after the effective date constitutes acceptance.
